An Application to Revoke Probation (also called community supervision) is filed by the State when a probationer allegedly violates the terms of their supervision. Unlike a criminal trial, a revocation hearing is conducted before a judge with no jury, and the State need only prove the violation by a preponderance of the evidence — a lower standard than beyond a reasonable doubt. If the judge finds a violation, probation can be revoked and the defendant sentenced to any term up to the maximum for the original offense. Violations range from new criminal arrests to technical violations such as failing a drug test, missing a reporting appointment, or failing to complete required community service.
