1. Acceptance of Terms

By accessing or using OpenArrest.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site. We may update these Terms at any time; continued use after changes constitutes acceptance.

2. Nature of the Data

OpenArrest.com publishes public arrest and booking records sourced from Travis County, Texas and Bexar County, Texas official law enforcement systems. This information is made publicly available by government agencies under Texas Public Information Act (Texas Gov't Code Ch. 552).

An arrest is not a conviction. All individuals listed on this Site are presumed innocent unless proven guilty in a court of law. The presence of a record on this Site does not imply guilt, criminal history, or ongoing legal jeopardy.

3. Prohibited Uses

You may not use the Site or its data for any of the following purposes:

  • Employment screening — using arrest records to make hiring, firing, or promotion decisions
  • Housing screening — using arrest records to make rental or housing decisions
  • Credit decisions — using arrest records in any credit underwriting process
  • Harassment or stalking — using personal information from records to locate, contact, or harass any individual
  • Bulk data harvesting — scraping, crawling, or automated download of records for redistribution
  • Doxxing — compiling or publishing personal information derived from this Site to expose or harm individuals
  • Unlicensed skip tracing — using records to locate individuals without appropriate legal authority

4. Not a Consumer Report — FCRA Notice

OpenArrest.com is not a consumer reporting agency as defined by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. The information available on this Site may not be used as a "consumer report" and may not be used for any purpose regulated by the FCRA, including but not limited to tenant screening, employment screening, or credit determination.

Any use of this Site's data for FCRA-regulated purposes is strictly prohibited and may expose you to significant civil and criminal liability under federal law.

5. Accuracy Disclaimer

Records are sourced directly from government databases and published as-is. OpenArrest.com makes no warranties, express or implied, as to the accuracy, completeness, or timeliness of any record. Data errors originating in government systems will be reflected in our database. We are not liable for inaccuracies in source data.

If you believe a record contains an error, you may submit a removal or correction request.

6. Record Removal Policy

Individuals may request suppression of their record from public display on this Site by submitting a removal request. We process verified requests immediately and at no charge. Removal suppresses the record from our public index; it does not delete the underlying government record, which remains with the originating agency.

We will suppress records in the following circumstances without requiring verification:

  • The record has been expunged or sealed by a court
  • The person was a minor at the time of the arrest
  • Charges were dismissed or the person was acquitted
  • The record contains demonstrable factual errors

We automatically de-index (noindex) records older than 90 days from search engines as a baseline privacy measure, regardless of disposition.

We do not charge any fee for record removal. Any site or service claiming to remove records from OpenArrest.com for a fee is not affiliated with us.

7. No Fee for Removal — Texas Business & Commerce Code § 109.005 Compliance

OpenArrest.com does not and will not charge any fee, solicit any payment, or require any consideration of any kind in exchange for the removal, correction, modification, or suppression of any criminal history record information published on this Site. This policy is consistent with Texas Business & Commerce Code § 109.005, which prohibits the publication of criminal history record information in print or electronic form when a fee is required to remove or correct the information.

Record removal is, and will always remain, free of charge through our online removal form. We do not accept "expedited removal" payments, "privacy protection" subscriptions, or any other form of payment tied to record visibility. Any third party offering to remove records from OpenArrest.com for a fee is not affiliated with us, is not authorized to act on our behalf, and should be reported to the Texas Attorney General's Consumer Protection Division.

We also do not display mugshot photographs obtained from jail booking systems on record pages. Booking photographs are not republished here, regardless of their public-records status.

8. Lead Generation Services

OpenArrest.com operates a lead generation service connecting individuals seeking bail bond and legal representation services with licensed professionals. By submitting an inquiry form on this Site, you consent to be contacted by licensed bail bondsmen and/or criminal defense attorneys regarding the services requested.

Partners in our lead network are licensed professionals subject to their respective state licensing requirements (Texas Department of Insurance for bail bondsmen; State Bar of Texas for attorneys). OpenArrest.com does not provide legal advice, bail bond services, or legal representation. We are a lead generation intermediary only.

Lead partners agree that: (a) they are properly licensed in Texas; (b) they will contact leads only regarding the services requested; (c) they will comply with the Telephone Consumer Protection Act (TCPA) and all applicable marketing laws; (d) lead fees are non-refundable once the lead is delivered.

9. Intellectual Property & DMCA

The OpenArrest.com platform, design, code, and non-governmental content are owned by OpenArrest.com and protected by copyright. Public arrest record data is not copyrightable and is published as a public service. You may link to individual record pages but may not reproduce our platform or design without written permission.

DMCA Takedown Notices. OpenArrest.com respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent. Notices must include (a) a physical or electronic signature of the copyright owner or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and its URL; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement under penalty of perjury that the information is accurate and you are authorized to act. Send notices to [email protected]. We will respond to valid notices promptly.

10. Third-Party Content & Section 230

Substantially all of the factual information on OpenArrest.com — booking numbers, names, charges, dates, and facilities — is sourced from third-party government information providers (county sheriff's office jail management systems) and is republished without editorial modification to the underlying facts. To the fullest extent permitted by 47 U.S.C. § 230, OpenArrest.com is an interactive computer service and is not the publisher or speaker of information provided by another information content provider. Claims that OpenArrest.com is liable for the accuracy of government-provided booking data are preempted by Section 230 and by the absolute privilege afforded to fair and accurate republication of official public records under Texas common law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPENARREST.COM AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR THE DATA CONTAINED HEREIN. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

You agree to indemnify and hold harmless OpenArrest.com, its operators, and affiliates from any claims, damages, or expenses arising from your use of the Site in violation of these Terms.

12. Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site — except for small claims court actions and actions seeking injunctive relief for intellectual property infringement — shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Travis County, Texas, or at another location mutually agreed upon. The arbitrator's decision shall be final and binding.

Class Action Waiver. You and OpenArrest.com agree that any dispute shall be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

If you do not wish to be bound by this arbitration provision, you may opt out by sending written notice to [email protected] within 30 days of your first use of the Site, including your name and a clear statement that you opt out of arbitration.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You waive any objection to jurisdiction or venue in such courts.
