Tampering with an Electronic Monitoring Device under Texas Penal Code § 38.112 is a Third-Degree Felony punishable by 2 to 10 years in prison and a fine of up to $10,000. The statute makes it a crime to knowingly remove, alter, damage, circumvent, or otherwise tamper with an electronic monitoring device that a court, parole authority, or pretrial services agency has ordered the person to wear. The charge most commonly arises when a person released on bond or community supervision under Travis County's pretrial services program removes or defeats their GPS ankle monitor. Because ankle monitors are a condition of release, tampering with one typically also triggers a bond revocation and may result in immediate re-arrest.
